Case summary: On August 24, 2015, Plaintiff filed a pro se lawsuit in Larimer County District Court alleging various constitutional violations with respect to his DUI arrest on March 1, 2014 and the outcome of the internal investigation into his complaint regarding the arresting officers. The City filed a Motion to Dismiss on December 7, 2015 and a response was filed by the Plaintiff on December 28, 2015. On March 28, 2016 the Court ordered all discovery and other matters on this case stayed pending resolution of the City’s Motion to Dismiss. On September 29, 2016 Magistrate Judge Watanabe dismissed all of the claims against all of the City defendants. On October 27, 2016, Plaintiff filed a Notice of Appeal. The plaintiff filed his opening brief with the United States Court of Appeals for the Tenth Circuit on January 24, 2017. The City filed its response brief on February 23, 2017. On April 26, 2017, the United States Court of Appeals for the Tenth Circuit issued an Order and Judgment affirming the district court’s ruling.
